AN ORDINANCE MODIFYING THE DOMESTIC VIOLENCE PREVENTION COORDINATING COUNCIL IN LOUISVILLE/ JEFFERSON COUNTY METRO GOVERNMENT CODE OF ORDINANCES (“LMCO”) SECTIONS 32.977 AND 32.979.

WHEREAS, The Domestic Violence Prevention Coordinating Council (DVPCC) was established to improve inter-agency cooperation and communication in the area of domestic violence and abuse; to promote effective prevention, intervention, and treatment based upon research and data collection; and to improve the system response to domestic violence and abuse so as to reduce incidents thereof;
WHEREAS, the DVPCC recommends modifying the ordinance to update the membership list and to clearly differentiate between individuals serving by virtue of office and appointed representatives; and
WHEREAS, the DVPCC also recommends amending the ordinance to make the provisions, i.e. appointed terms and procedures, more consistent with other Louisville Metro Government appointed entities.
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (THE COUNCIL) AS FOLLOWS:
SECTION I: LMCO Section 32.977 is hereby amended as follows:
§ 32.977 MEMBERSHIP.
(A) The business, activities and affairs of the Council shall be managed by its membership which shall include, but is not limited to, the following or their representatives:(A) Membership includes the following, who shall serve by virtue of office or position or their designated representative from their respective office:
Mayor, Louisville/Jefferson County Metro Government;
Public Protection Secretary, Louisville/Jefferson County Metro Government;
President, of the Louisville Metro Council;
Chief, Louisville Metro Police Department Chief;
Jefferson County Attorney;
Jefferson County Commonwealth's Attorney;
Jefferson County Circuit Court Clerk;
Jefferson County Sheriff;
Director of the Louisville Metro Criminal Justice Commission;
Director, of the Louisville Metro Office for Women;
Director, Louisville Metro Department of Corrections;
Director, Louisville Metro Youth Detention Services;
Secretary, Metro Government Correctional Services Department;
Director, Office of Probation and Parole for 30th Judicial District;
State Medical Examiner;
Jefferson County Coroner;
Superintendent, Jefferson County School Board;
A Jefferson County District Court Judge; Chief Judge, Jefferson District Court;
A Jefferson County Circuit Court Judge; Chief Judge, Jefferson Circuit Court;
A Jefferson County Family Court Judge; Chief Judge, Jefferson Family Court;
A member of the Chair, Jefferson County Legislative Delegation;
A representative of the Jefferson County Metro Public Defender's Office;
Director, A representative of the Louisville Bar Association;
Director, A representative of the Jefferson County Greater Louisville Medical Society;
A representative of the Cabinet for Families and Children, Child Protective Services; Director, Adult/Child Protective Services, Cabinet for Health & Family Services;
A representative from a court ordered batterers program; Representative, Batterer Intervention Program;
President, Center for Women and Families;
A representative from a child service agency; Representative, Child Service Agency;
A member active in a prominent minority-oriented civic organization; Representative, Prominent Minority-Oriented Civic Organization;
A member active in a prominent local business organization; and Representative, Prominent Local Business Organization;
Four Citizens from the Community At-Large.; and
Co-Chairs of Standing DVPCC Committees.
Representatives should be at the policy making level of their respective organizations.
(B) Members shall be appointed by the Mayor of Louisville/Jefferson County Metro Government subject to the approval of the Metro Council. One member (who may or may not be one of those listed above) shall be appointed as the Chairman of the Council. Each member shall serve a two-year term and until his or her successor is appointed. A member is eligible to succeed himself. Should a vacancy occur, appointment shall be only for the unexpired term.
(B) Agency representatives and citizen members shall be appointed by the Mayor of Louisville/Jefferson County Metro Government subject to the approval of the Metro Council. Two members (who may or may not be one of those listed above) shall be appointed to serve as Co-Chairs of the Council. Each appointed agency representative or citizen member shall serve a three-year term and until his or her successor is appointed. An agency representative or citizen member may be reappointed for one three-year term. Should a vacancy occur, appointment shall be only for the unexpired term.
SECTION II: LMCO Section 32.979 is hereby amended as follows:
§ 32.979 BYLAWS; COMMITTEES; STAFFING.
(A) The Council shall may adopt bylaws and other rules as it deems necessary for its organization and proceedings consistent with the laws, ordinances and resolutions of the Commonwealth of Kentucky and Louisville/Jefferson County Metro Government.
(B) The Council may create standing and temporary committees for such purposes and needs as may arise in the performance of the Council's duties. Staff assistance shall be provided to the Council by the Louisville Metro Criminal Justice Commission.
SECTION III: This Ordinance shall take effect upon its passage and approval.
