AN ORDINANCE CHANGING THE ZONING FROM R-6 RESIDENTIAL MULTI-FAMILY TO R-7 RESIDENTIAL MULTI-FAMILY ON PROPERTY LOCATED AT 7100 LEISURE LANE CONTAINING 10.83 ACRES AND BEING IN LOUISVILLE METRO (CASE NO. 17ZONE1069) (AS AMENDED).

                     WHEREAS, The Legislative Council of the Louisville/Jefferson County Metro Government (the “Council”) has considered the evidence presented at the public hearing held by the Louisville Metro Planning Commission and the recommendations of the Planning Commission and its staff as set out in the minutes and records of the Planning Commission in Case No. 17ZONE1069; and

WHEREAS, the Council concurs in and adopts the findings of the Planning Commission for the zoning change in Case No. 17ZONE1069 and approves and accepts the recommendations of the Planning Commission as set out in said minutes and records with an two additional binding elements;

NOW THEREFORE BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (“COUNCIL”) AS FOLLOWS:

 

                     SECTION I:                     That the zoning of the property located at 7100 Leisure Lane containing 10.83 acres and being in Louisville Metro, as more particularly described in the minutes and records of the Planning Commission in Case No. 17ZONE1069, is hereby changed from R-6 Residential Multi-Family to R-7 Residential Multi-Family; provided, however, said property shall be subject to the binding elements as set forth in the minutes of the Planning Commission in Case No. 17ZONE1069 as well as the following additional binding elements:.

 

13. Any change in the existing development plan as it is today, including the old buildings and the new buildings, will require a Planning Commission public hearing, approval by the Planning Commission, and final approval by Metro Council.Any proposed change in parking or increase in density on the subject property must first have a public hearing before the Planning Commission and shall be reviewed by the Metro Council which will take final action to approve or deny the proposal.

 

14. The north side of Leisure Lane from Park Lake Drive to Paxton Wilt Road and the east side of Park Lake Drive from Leisure Lane to the end of the subject property shall be posted as “NO PARKING”.

 

                     SECTION II:                     This Ordinance shall take effect upon its passage and approval.
