A RESOLUTION REQUESTING THE LOUISVILLE/JEFFERSON COUNTY PLANNING COMMISSION TO ADOPT A REGULATION PROVIDING FOR APPEALS TO THE METRO COUNCIL IN SUBDIVISION CASES.

WHEREAS, KRS 100.273(1) authorizes Planning Commissions to adopt regulations for the subdivision of land within its boundaries;
WHEREAS, the current Land Development Code (“LDC”) does not provide for any administrative appeal of Planning Commission decisions in subdivision cases;
WHEREAS, LDC § 11.7.5 provides for development plans to be appealed to the Metro Council but does not provide such appeal provisions for subdivision cases; WHEREAS, major subdivisions and conservation subdivisions have the potential to create significant impacts to area infrastructure and neighborhood stability; and
WHEREAS, the Metro Council desires to have some oversight in the subdivision process to address such potential impacts.
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (“METRO COUNCIL”) AS FOLLOWS:
SECTION I: The Planning Commission shall adopt a provision in the Land Development Code to provide for appeals to the Metro Council of all major subdivisions and conservation subdivisions.
SECTION II: This Resolution shall take effect upon its passage and approval.
