WHEREAS, Metro Council recently amended LMCO ? 150.110 in which it granted an exception for demolitions intended to protect health and safety pursuant to LMCO ?? 156.806 and 156.807; and
WHEREAS, this exception had the unintended consequence of no longer requiring public notice for LMCO ? 156.807 demolitions, which had been noticed before; and
WHEREAS, Metro Council acknowledges both the value of providing notice of such demolitions to the community; and
WHEREAS, to address this unintentional change, Metro Council modifies the exception granted to LMCO ? 156.807 demolitions to again require public notice of such demolitions.
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

SECTION I. LMCO ? 150.110(F) is hereby amended as follows:
?150.110 WRECKING OR DEMOLITION OF HISTORIC BUILDINGS OR STRUCTURES.
(F) Exceptions.
(1) This section shall not apply:
(a) In any case where the Department, the Division of Fire, a Fire Protection District, the Board of Health, or any officer or agency thereof, or any court of justice orders or directs the demolition of any structure or building for the purpose of remedying conditions determined to be dangerous to life, health or property; or
(b) To demolitions intended to protect health and safety pursuant to LMCO ?? 156.806 and 156.807.
(2) Demolitions intended to protect health and safety pursuant to LMCO ? 156.807 shall not be subject to subsections (D) and/or (E) above.
