A RESOLUTION REQUESTING THE LOUISVILLE/JEFFERSON COUNTY PLANNING COMMISSION TO REVIEW THE LAND DEVELOPMENT CODE REGULATIONS WITH REGARD TO THE PRESERVATION AND PLANTING OF TREES (AS AMENDED).

WHEREAS, proposed changes to the Land Development Code related to Landscaping Tree Preservation were deferred in 2014, pending completion of Louisville’s Urban Tree Canopy Assessment (“UTCA”);
WHEREAS, the UTCA was completed in 2015, showing a substantial reduction in Louisville’s tree canopy from 2004 to 2012, and predicting further losses in the absence of new policies; and
WHEREAS, Metro Council enacted a new Public Tree Ordinance in 2017 in part as a result of the UTCA but the Ordinance does not deal with trees in the development context and such changes must be initiated through the Planning Commission pursuant to Kentucky statute.
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I: The Planning Commission shall undertake a review of the Land Development Code and propose amendments thereto regarding the requirements to preserve tree canopy and plant trees, with the goals of reducing tree canopy loss and increasing Louisville’s tree canopy., and to report back to Metro Council by March 1, 2019.
SECTION II: This resolution shall take effect upon its passage and approval.
