WHEREAS, Louisville Metro Council is empowered under KRS 67C.139(2) to “enact an ordinance setting out the role of the legislative council, if any, in the appointment process for each individual agency, board, and commission created by statute”; and 

WHEREAS, Louisville Metro Council wishes to increase transparency of Metro Government’s boards and commissions by requiring on-line publication of approved meeting minutes on the Louisville Metro Government website, www.louisvilleky.gov.

BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (THE COUNCIL) AS FOLLOWS:

 

SECTION I:  LMCO Chapter 32 is hereby amended to add the following section:

§ 32.004 PUBLIC MEETING NOTICES

(1) All boards and commissions established by Louisville Metro Code of Ordinances which have members appointed by the Mayor and approved by the Metro Council are required to publish meeting minutes on the Louisville Metro Government website, www.louisvilleky.gov for a period of at least 5 years.  The meeting minutes must be posted at least one week after the adoption of the meeting minutes but no later than two months following the meeting, even if the meeting minutes are not adopted by the board or commission. All minutes posted must be redacted to take out any information exempt from disclosure under KRS 61.878 of the Kentucky Open Records Act.

(2) Failure to comply with the publication requirements set forth in subsection one (1) may be grounds for removal of the chair of the board or commission under KRS § 67C.103(14)(d). 

SECTION II:  For all meetings that occur after January 1, 2019 publication requirements established in this Ordinance shall be effective and minutes shall be made available to the public through the www.louisvilleky.gov website. by no later than January 1 of 2019.  Meeting minutes from 2017 and 2018 shall be made available to the public through the www.louisvilleky.gov website by May 1, 2019.
