AN ORDINANCE AMENDING SECTIONS 32.141 AND 32.171 OF THE LOUISVILLE METRO CODE OF ORDINANCES REGARDING THE REIMBURSEMENT OF HEALTH INSURANCE.

                     WHEREAS, Metro Council desires to amend the Louisville Metro Code of Ordinances (“LMCO”)  §§ 32.141 and 32.171 to reimburse for health care based on the amount allocated rather than the minimum funding linked to the effective rate in January 2011; and

WHEREAS, Metro Council desires for the retired police and firefighter beneficiaries who have served Louisville to not endure any potential decrease in their annual amount of health care reimbursement.

NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

 

SECTION I.  Section 32.141 of LMCO is hereby amended as follows:

§ 32.141  TEMPORARY PAYMENTS TO RETIRED MEMBERS AND BENEFICIARIES.

 

   (A)   Insurance reimbursements.  Each retired member or beneficiary of a retired member who is receiving a monthly annuity shall be eligible to receive a monthly reimbursement not to exceed that amount equal to the maximum Metro Government contribution ever allocated, or the amount effective January 2011, whichever is higher, to the cost of health insurance for employees covered under the Classification and Compensation Ordinance for any single-coverage premiums that the annuity recipient pays out-of-pocket for his or her own health insurance coverage.

 

   (B)   Conditions of payments.

 

      (1)   Payment of the insurance reimbursement is subject to the appropriation of funds in future years for said payment.

 

      (2)   To qualify for the insurance reimbursement, the annuity recipient must provide documentation that shows his or her single-coverage health insurance premium payments.      (3)   The cost of the insurance reimbursements shall be reimbursed to the Policemen's Retirement Fund by the Metro Government, upon receipt of proper documentation from the Fund, which shall include the names, amounts, and dates of payments to each recipient.

 

      (4)   The benefits described in this section shall not be taken into consideration in the annual actuarial valuation of the Fund.

 

SECTION II.  Section 32.171 of LMCO is hereby amended as follows:

§ 32.171  TEMPORARY PAYMENTS TO CERTAIN RETIRED MEMBERS AND BENEFICIARIES.

 

   (A)   Insurance reimbursements.  Each retired member or beneficiary of a retired member who is receiving a monthly annuity shall be eligible to receive a monthly reimbursement not to exceed that amount equal to the maximum Metro Government contribution ever allocated, or the amount effective January 2011, whichever is higher, to the cost of health insurance for employees covered under the classification and compensation ordinance for any single-coverage premiums that the annuity recipient pays out-of-pocket for his or her own health insurance coverage.

 

   (B)   Conditions of payments.

 

      (1)   Payment of the insurance reimbursement is subject to the appropriation of funds in future years for said payment.

      (4)   The benefits described in this section shall not be taken into consideration in the annual actuarial valuation of the Fund.

 

SECTION III.  This ordinance shall take effect upon its passage and approval.
