AN ORDINANCE CHANGING THE ZONING FROM R-4 SINGLE-FAMILY RESIDENTIAL AND C-2 COMMERCIAL TO M-2 INDUSTRIAL ON PROPERTY LOCATED AT 8325, 8329, AND 8401 NASH ROAD AND 806, 711, 715, 717, 719, 801, 803, AND 805 HAY COURT CONTAINING 3.66 ACRES AND BEING IN LOUISVILLE METRO (CASE NO. 17ZONE1041) (AS AMENDED).

WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government (the "Council") has considered the evidence presented at the public hearing held by the Louisville Metro Planning Commission and the recommendations of the Planning Commission and its staff as set out in the minutes and records of the Planning Commission in Case No. 17ZONE1041; and
WHEREAS, the Council concurs in and adopts the findings of the Planning Commission for the zoning change in Case No. 17ZONE1041 and approves and accepts the recommendations of the Planning Commission as set out in said minutes and records with an additional binding element.
NOW THEREFORE BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

SECTION I: That the zoning of the property located at 8325, 8329, and 8401 Nash Road and 806, 711, 715, 717, 719, 801, 803, 805 Hay Court containing 3.66 acres and being in Louisville Metro, as more particularly described in the minutes and records of the Planning Commission in Case No. 17ZONE1041, is hereby changed from R-4 Single-Family Residential and C-2 Commercial to M-2 Industrial; provided, however, said property shall be subject to the binding elements as set forth in the minutes of the Planning Commission in Case No. 17ZONE1041., with the following additional binding element:
8. The Applicant shall submit a landscape plan for review by the Planning and Design staff that will include a vegetative buffer along Nash Road outside of the drainage easement.
