AN ORDINANCE CHANGING THE ZONING FROM R-4 RESIDENTIAL SINGLE FAMILY TO PRD PLANNED RESIDENTIAL DEVELOPMENT ON PROPERTY LOCATED AT 14706 AND 14714 OLD HENRY ROAD CONTAINING 5.69 ACRES AND BEING IN LOUISVILLE METRO (CASE NO. 18ZONE1033) (AS AMENDED).

WHEREAS, The Legislative Council of the Louisville/Jefferson County Metro Government (the “Council”) has considered the evidence presented at the public hearing held by the Louisville Metro Planning Commission and the recommendations of the Planning Commission and its staff as set out in the minutes and records of the Planning Commission in Case No. 18ZONE1033; and
WHEREAS, the Council concurs in and adopts the findings of the Planning Commission for the zoning change in Case No. 18ZONE1033 and approves and accepts the recommendations of the Planning Commission as set out in said minutes and records with additional binding elements.
NOW THEREFORE BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I: That the zoning of the property located at 14706 and 14714 Old Henry Road containing 5.69 acres and being in Louisville Metro, as more particularly described in the minutes and records of the Planning Commission in Case No. 18ZONE1033, is hereby changed from R-4 Residential Single Family to PRD Planned Residential Development; provided, however, said property shall be subject to the binding elements as set forth in the minutes of the Planning Commission in Case No. 18ZONE1033., with the following additional binding elements:
21. No later than 180 days after construction activity specifically involving improvements to the portion of Old Henry Road adjacent to or including the development site has ceased, pursuant to KYTC Project No. 5-367.20, applicant/developer shall submit for approval to Louisville Metro Planning and Design Services a landscape/tree canopy plan whereon the required tree plantings shall establish a tree canopy of no less than 40% of the development site, as calculated in Chapter 10 of the Land Development Code. The cessation of construction activity referred to herein shall be confirmed by KYTC in writing (email correspondence is sufficient).
22. Amendments to binding elements shall require the Louisville Metro Council’s approval.
SECTION II: This Ordinance shall take effect upon its passage and approval.
