TITLE

AN ORDINANCE CREATING A NEW CHAPTER UNDER TITLE XI OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT CODE OF ORDINANCES (“LMCO”) REQUIRING THE PLACEMENT OF A REFLECTIVE DECAL IN THE 10TH FLOOR WINDOWS OF TALL BUILDINGS AS A VISIBLE MARKER OF THE HEIGHT OF THE BUILDINGS IN ORDER TO ASSIST LOUISVILLE METRO POLICE DEPARTMENT AND OTHER EMERGENCY RESPONSE PERSONNEL (AS AMENDED).

WHEREAS, Louisville Metro Government seeks to be proactive in emergency response planning and preparation in order to protect our citizens;

WHEREAS, tragic events in larger cities during large gatherings have brought attention to the necessity for emergency response personnel to quickly determine the height of tall buildings during a variety of emergency situations;

WHEREAS, placing a reflective decal in corner windows on the 10th floor (and every 10 floors thereafter) of tall buildings as a visible marker for the height of these buildings will reduce the response time of the Louisville Metro Police Department and other emergency response agencies in many emergency situations in and around tall buildings;

WHEREAS, this effort of marking buildings every 10th floor will help Louisville Metro Government add a tool to its security plan; and

WHEREAS, Louisville Metro Government has determined that it is in the best interest of the health, safety, and welfare of residents of Jefferson County and its visitors to require persons and businesses that own, operate, and maintain buildings at least ten stories high to provide this new emergency response measure.

NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

 

SECTION I:                       Creates a new chapter under Title XI as follows:

§128.XXX  DEFINITIONS.

For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

BUILDING EMERGENCY RESPONSE REGISTRY.  The registry listing all buildings at least 10 stories high in order for LMPD and other emergency response agencies to be able to better respond to emergency situations in and around such tall buildings.

BUILDING SECURITY DIRECTOR.  A designated individual who is the single point of contact for each building at least 10 stories high who will assist LMPD and other emergency response agencies in the event of an emergency situation.

OWNER.  An individual, corporation, partnership, trustee, lessee, agent or assignee or any equitable title in real property.

REFLECTIVE DECAL.  The reflective weather-resistant sticker provided by Louisville Metro Police Department to be placed in corner windows as noted in this subchapter. 

FLOOR is the floor that the elevator has numbered.

§128.XXX  BUILDING EMERGENCY RESPONSE REGISTRY-REGISTRATION REQUIRED.

(A)                     LMPD shall develop and maintain a Building Emergency Response Registry that lists all buildings at least 10 stories high and contains the information as described in this subchapter.  

(B)                     The owner of any building which is at least 10 stories high shall register all such buildings with LMPD in accordance with the provisions of this subchapter by the effective date of this subchapter, or within 30 days of taking ownership of such building(s). 

(C)   The registration shall be available through LMPD and shall include the following information:

(1)   A description of the building by street address, building name (if applicable), and number of stories in the building;

(2)                     The name, mailing and physical address(es), telephone number, and email address of the owner of the property. If the owner is a partnership, corporation, limited partnership, limited liability company, or similar entity, the organization shall furnish the name, mailing and physical address(es), telephone number, and email address of a responsible individual partner or officer; and

(3)                      The names, mailing and physical addresses, emergency telephone numbers, and email addresses of the building security director. The registration must be updated within 30 days of new building security director or modified contact information.

(D)                     Any Owner required to register pursuant to subsection (B) above shall be required to pay a registration fee established by the LMPD according to the number of reflective decals provided. 

 

§128.XXX.  PLACEMENT OF REFLECTIVE DECAL REQUIRED.

(A)                     The LMPD will design and make available the reflective decals for the owner of the building upon registration on the Building Emergency Response Registry.                       The LMPD-issued reflective decals provide a visible marker that will allow LMPD and other emergency response personnel to quickly determine the height of tall buildings. 

(B) Owners of buildings 10 stories high and taller shall place the reflective decals in the eight corner windows on the 10th floor and every 10th floor thereafter.  The reflective decals may be placed on the inside of the windows but must be visible from outside at street level.  If the windows are tinted or the reflective decals are not clearly visible from street level, the decals shall be placed on the outside of the window.

§128.XXX  ENFORCEMENT.  

                     

LMPD shall make available a Building Emergency Response Registry form for owners of at least 10 story buildings to register and obtain the necessary number of reflective decals.  Any person or entity that violates the provisions of this chapter shall be subject to citation issued by any law enforcement officer and/or code enforcement officer. Citations shall be enforced through the Code Enforcement Board as provided in §§ 32.275 et seq., or as it may be amended.

                     SECTION II:  Amends LMCO § 128.999 as follows:

§128.999  PENALTY.

                                            The failure to register and/or maintain current information and place reflective decals on a 10-story building in accordance with § ____ shall be classified as a civil offense with a penalty of up to $500 per building. Each day of a violation may constitute a separate offense.

                     SECTION III:                      This Ordinance shall take effect upon its passage and approval.
