                     WHEREAS, Louisville strives to be an inclusive city for all its citizens regardless of abilities or disabilities and seeks to create an environment where all Louisvillians are afforded the opportunity to experience the full integration and participation of people with disabilities in our city.

NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

 

                     SECTION I:                     A new Section of LMCO Chapter 32 is created to read as follows:

COMMISSION FOR PERSONS WITH DISABILITIES

§ 32._____  ESTABLISHMENT.

The Louisville Metro Commission for Persons with Disabilities (“the Commission”) is hereby established with the following purpose and authority:

(A) Advise the Mayor and the Council on issues of access, representation, employment, housing and quality of life affecting citizens with disabilities and their families;

(B) Serve as a resource for citizens with disabilities and their families to express concerns and solutions regarding issues affecting them;

(C) Publicize the role of the Commission for people with disabilities and the resources available to assist citizens with disabilities, employers, housing representatives, business owners, engineers and architects, and others who have a role in bettering the community; 

(D) Promote awareness to the general public of the capabilities, needs and desires of citizens with disabilities;

(E) Publicly recognize the efforts of employers, businesses, schools, organizations, individuals, and others who have demonstrated outstanding support of programs and services for citizens with disabilities;

(F) Serve as advocate for accessibility issues and implementation of plans and projects to improve services for citizens with disabilities;

(G) Advise Louisville Metro departments and divisions on policy matters which affect the daily lives of people with disabilities, especially with regard to public facilities; and

(H) Make recommendations to the Mayor and Council as it deems appropriate.

§ 32.____  MEMBERSHIP.

(A)                     The Commission shall consist of 13 members.  Members shall be appointed by the Mayor with the approval of the Louisville Metro Council. The thirteen (13) appointed members shall include the following: two (2) members from Louisville Metro Council; four (4) members from organizations or individuals representing people with disabilities; one (1) member representing the business community; one (1) member representing a regional college or university; one (1) member representing rehabilitation professionals; two (2) members from employment and/or education advocacy organizations; and two (2) members from the community at large. An ADA coordinator for Louisville Metro Government or designee, the Director of Metro Parks or designee, the Director of Public Works or designee, and the Director of Develop Louisville or designee, and the Director of the Human Relations Commission or designee shall serve as ex-officio members.

(B)   The appointment term of each Commission member shall be 4 years, except for initial appointment terms.  Initial appointment terms shall be staggered as follows: two members appointed to one year terms; two members appointed to two year terms; and one member appointed to a three year term.

(C)   Members shall serve without compensation.

§ 32.____ BYLAWS; COMMITTEES; STAFFING.

(A)                     The Commission shall annually elect a chair from its members.

(B)                     The Commission shall adopt bylaws and other rules as it deems necessary for its organization and proceedings consistent with the laws.

 (C)   The Commission may create standing and temporary committees for such purposes and needs as may arise in the performance of the Commission's duties.

  (D)   Louisville Metro Government will provide staff assistance to the Commission.
