                     WHEREAS, Logan Street Market, also known as “Louisville’s Urban Public Market,” is a registered Public Benefit Corporation that exists to provide healthy, fresh, local food to an underserved community and to be a leader in sustainable practices and events and to be a community gathering space for people to learn, grow, and connect; 

WHEREAS, Logan Street Market is scheduled to open in the fall of 2019 and hopes to be a destination for Louisvillians and visitors where local chefs and artisans are showcased;

WHEREAS, Logan Street Market will also offer fresh seasonal produce to residents as well as single indoor, open market inclusive of the cultures that reflect the neighborhood with African crafts, bubble tea, Venezuelan street food, and an outdoor farmer’s market on weekends;

WHEREAS, Louisville Metro Government seeks to create an Entertainment Destination Center for the Logan Street Market area for which the Logan Street Market will apply for a license from the Louisville Metro Alcoholic Beverage Control and the Kentucky Department of Alcoholic Beverage Control;

WHEREAS, KRS § 243.030(21) authorizes the issuance of an Entertainment Destination Center (“EDC”) License by the Kentucky Department of Alcoholic Beverage Control; 

WHEREAS, the state ABC regulations require the Louisville Metro enact an ordinance with the geographic boundaries of the EDC and a determination that the licensed premises would aid economic growth and tourism in the county or city (804 KAR 4:370); and

WHEREAS, Louisville Metro Council believes the creation of an Entertainment Destination Center in the Logan Street Market area as defined in this ordinance will aid in the economic growth of tourism in Louisville Metro.

BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

 

SECTION I:  A new section of Chapter 113 of the Louisville Metro Code of Ordinances (“LMCO”) is hereby created as follows:

§ 113.XX:                     LOGAN STREET MARKET ENTERTAINMENT DESTINATION CENTER

(A) Louisville Metro hereby establishes an Entertainment Destination Center (“EDC”) at the Logan Street Market upon the belief that the Logan Street Market satisfies the requirements contained in the definition of an EDC as required by Section 1 of 804 KAR 4:370, including the belief that the Logan Street Market area will aid economic growth and tourism in Louisville Metro and for the community around Logan Market Street area. 

(B) The geographical boundaries of the Logan Street Market area EDC lies within and adjacent to the following description: 

Beginning at a point located at the intersection of the Western right-of-way line of a fifteen (15) foot alley and the Northern right-of-way line of St. Catherine Street (having a sixty foot right-of-way); thence leaving said Western right-of-way line of a fifteen (15) foot alley, run in a Westerly direction along said Northern right-of-way line of St. Catherine Street North 90⁰ 00’ West a distance of 150.00 feet to a point at the intersection of said Northern right-of-way line of St. Catherine Street with the Eastern right-of-way line of Logan Street; then leaving said Northern right-of-way line of St. Catherine Street, run in a Northerly direction along said Eastern right-of-way line of Logan Street North 00⁰ West a distance of 160 feet to a point; then leaving said Eastern right-of-way line of Logan Street, run in an Easterly direction South 90⁰ 00’ East a distance of 150.00 feet to a point in the Western right-of-way line of a fifteen (15) foot alley; then running in a Southerly direction along said Western right-of-way line of a fifteen (15) foot alley South 00⁰ East a distance of 160 feet to a point located at the intersection of said Western right-of-way line of a fifteen (15) foot alley and the Northern right-of-way line of St. Catherine Street (having a sixty foot right-of-way), said point being the TRUE POINT OF BEGINNING. 

 

The area designated for the EDC shall also include the sidewalks adjacent to the above-referenced parcel on Logan Street and St. Catherine Street.

(C)  The Logan Street Market EDC hours are as follows: Seven (7) days a week 7:00 a.m. through 12:00 a.m.   Monday through Saturday 7:00 a.m. until 10:00 p.m. and Sundays 7:00 a.m. until 3:00 p.m.

(D)  The Logan Street Market shall comply with all applicable laws and licensing requirements to operate as an EDC. 

SECTION II:  This Ordinance shall take effect upon its passage and approval.
