A RESOLUTION DETERMINING A PARCEL OF REAL PROPETY LOCATED AT 431 EAST LIBERTY STREET, LOUISVILLE, KENTUCKY, A DESCRIPTION OF WHICH IS ATTACHED HERETO AS EXHIBIT A AND OWNED BY LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (“METRO GOVERNMENT”) AS SURPLUS AND NOT NEEDED FOR A GOVERNMENTAL PURPOSE AND AUTHORIZING ITS RECONVEYANCE TO LOUISVILLE METRO HOUSING AUTHORITY (“HOUSING AUTHORITY”) FOR $1.00.

WHEREAS, according to KRS Chapter 67C 101, Metro Government may sell any real property belonging to Metro Government; and
WHEREAS, Section 1 (A) of Executive Order No.2, Series 2011 of the Mayor, which adopts Section 2(C) of Executive Order No.3, Series 2007, provides that Metro Government may sell and convey surplus real estate upon declaration by the Legislative Council of Metro Government (“the Council”) that such property is no longer needed for the governmental purposes of Metro Government; and
WHEREAS, the real property located at 431 East Liberty Street, Louisville, Kentucky (the “Property”) was conveyed by the Housing Authority to Metro Government for $1.00 by a Deed With Included Option dated January 31, 2019 and recorded in Deed Book 11340, Page 382 in the Office of the Clerk of Jefferson County, Kentucky, and
WHEREAS, the Property was conveyed to Metro Government for the purpose of safe storage for the personal property of the homeless in Louisville/Jefferson County, a purpose which has been completed, and
WHEREAS, Housing Authority retained an option in the abovementioned Deed With Included Option to repurchase the Property from Metro Government for $1.00, and
WHEREAS, Housing Authority has properly exercised abovementioned option, and
WHEREAS, the Chief of Staff of Louisville/Jefferson County Metro Government has declared and certified to the Council that the Property is surplus to the needs of Metro Government,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL AS FOLLOWS:
SECTION I: The Council hereby declares the Property described in Exhibit A hereto as “SURPLUS” and determines that it is not needed to carry out the governmental functions of Metro Government.
SECTION II: The Mayor is hereby authorized to convey the Property to the Housing Authority for the sale price of $1.00 in the manner provided according to Section 2 of Executive Order No.3, Series 2007, without further action by the Council.
SECTION III: This Resolution shall take effect upon its passage and approval.

CERTIFICATION OF SURPLUS PROPERTY
The Chief of Staff of Louisville/Jefferson County Metro Government and the Directors of Louisville Forward and the Vacant and Public Property Administration have reviewed the Louisville/Jefferson County Metro Government’s needs for land or improvements used in the administration of Metro programs and to conduct municipal business. This office has determined that the parcel of Metro-owned real property noted below, and which is being scheduled for action by the Louisville Metro Council, is not needed or suitable for any specific municipal use.

BEGINNING at a point in the North line of Fehr Avenue said point being north 82 degrees 07 minutes 57 seconds West 60 feet from west line Jackson Street; thence with said line of Fehr Avenue 82 degrees 08 minutes 57 seconds West 305.19 feet; thence North 8 degrees 01 minutes 54 seconds East 215.88 feet; thence South 82 degrees 10 minutes 11 seconds East 260.16 feet; thence South 8 degrees 01 minutes 24 seconds West 70.92 feet to the wall of an existing brick building; thence with said wall and same extended South 81 degrees 40 minutes 37 seconds East 45 feet to a point 60 feet West of the West line of Jackson Street; thence southwardly and parallel with the West line of Jackson Street; South 8 degrees 01 minutes 24 seconds West 144.06 feet to the point of the beginning.
