AN ORDINANCE AMENDING CHAPTER 42 OF THE LOUISVILLE/ JEFFERSON COUNTY METRO CODE OF ORDINANCES TO PROVIDE COURSE MANAGEMENT OPPORTUNITES TO PROFESSIONALS DURING THEIR PGA TRAINING (AMENDMENT BY SUBSTITUTION).

WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government (“Metro Government”) believes that Metro-owned golf courses are important assets that contribute to the health and wellness of the citizens of Louisville Metro;
WHEREAS, Metro Council values and supports a continued small business relationship with PGA professionals for their many contributions to our community;
WHEREAS, to further encourage Metro Council’s relationship with PGA professionals, Metro Council believes it is important to provide course management opportunities to individuals during their professional training with the PGA;
WHEREAS, the management of Metro-owned nine-hole golf courses received less interest and fewer responses to a recent request for proposals than did the Metro-owned eighteen-hole golf courses;
WHEREAS, allowing individuals in the process of obtaining Class A PGA Membership to manage Metro-owned nine-hole courses would broaden the pool of potential candidates;
WHEREAS, Metro-owned nine-hole courses do not generate the revenue sufficient to feasibly allow a person or entity to hire a Class A PGA Member;
WHEREAS, Metro Council hereby amends Chapter 42.43(A) to allow individuals in the process of obtaining Class A PGA Membership to manage Metro-owned nine-hole courses.
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (“COUNCIL”) AS FOLLOWS:
SECTION I: LMCO Chapter 42.43(A) is hereby amended as follows:
(A) The person or entity must be or employ a Class A PGA Member (“Pro”) to manage each Metro-owned public golf course, or, for Metro-owned nine-hole courses only, an entry level PGA Pro, who: (1) shall have commenced the process to acquire Class A PGA Membership prior to the execution of any Metro golf course management contract; and (2) shall provide sufficient evidence of continued enrollment in the PGA program to Metro Parks on a biannual basis; and (3) shall complete such accreditation within two years of execution of the contract. to manage each Metro-owned public golf course. PGA professionals shall be provided the opportunity to submit proposals on all individual Metro-owned public golf courses. Pros in the process of acquiring Class A PGA Membership as outlined herein may submit proposals on Metro-owned nine-hole golf courses.
SECTION II: This Ordinance shall take effect upon passage and approval.
