AN EMERGENCY RESOLUTION INITIATING A REVIEW OF THE DECISION OF THE PLANNING COMMISSION TO APPROVE A REVISED DISTRICT DEVELOPMENT PLAN FOR THE PROPERTY LOCATED AT 105 ROCHESTER DRIVE IN LOUISVILLE METRO (AS AMENDED).

WHEREAS, the Planning Commission held a public hearing on November 19, 2020 on a proposal to revise the District Development Plan and grant a waiver for the property at 105 Rochester Drive in Louisville Metro (20-DDP-0047/20-WAIVER-0086), and the Commission on that same day by a vote of 6 For, 4 Opposed approved that revised development plan; and
WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government (“Council”) has the power and authority under the provisions of the Land Development Code (“LDC”), Section 11.7.5, to review and uphold, modify, or overturn that decision, and may place additional conditions or binding elements as it deems appropriate; and
WHEREAS, because of both the potential impact upon neighboring residential properties and the allegations of insufficient notice the Council finds that such a review is warranted; and
WHEREAS, This Ordinance requires emergency consideration as authorized by Council Rule 7.01 because the limitations of the regular Council calendar combined with the requirements of LDC Section 11.7.5 would make it impossible to review this matter without either emergency passage or the scheduling of several special meetings;
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (“COUNCIL”) AS FOLLOWS:
SECTION I: The Council hereby initiates a review of the November 19, 2020 decision of the Planning Commission to revise the District Development Plan for the property at 105 Rochester Drive in Louisville Metro. The Planning and Zoning Committee shall hold a special public hearing on the Plan on January 12, 2021, only rescheduling if necessary. This hearing shall consist of a review of the record before the Planning Commission by Planning and Design Staff, the answering of questions posed by Council members, and any new information offered by those for or against the proposal.
SECTION II: This Resolution shall take effect upon its passage and approval.
