AN ORDINANCE TEMPORARILY AMENDING THE PROVISIONS OF CHAPTER 113 OF THE LOUISVILLE METRO CODE OF ORDINANCES (LMCO) RELATING TO EXTENDED HOUR SUPPLEMENTAL LICENSES FOR THE SALE OF DISTILLED SPIRITS, WINE, AND MALT BEVERAGES.

WHEREAS, the Louisville Metro Police Department (“LMPD”) is currently facing a shortage of nearly 300 officers; and

WHEREAS, the local Alcoholic Beverage Control administrator also has limited resources for the enforcement of existing laws and regulations on the sale of alcoholic beverages; and

WHEREAS, 171 locations with extended hours licenses where alcoholic beverages are sold by the drink can currently serve alcohol until 4:00 a.m.; and 

WHEREAS, additional locations are currently seeking 4:00 a.m. licenses from the ABC administrator; and

WHEREAS, alcohol-related community harms include impaired driving, unintentional or intentional injuries, and violent crime; and

WHEREAS, a meta-analysis of 10 studies in Europe, Australia, and North America found “increasing hours of [alcohol] sales by 2 or more hours increases alcohol-related harms,” and decreasing sales hours can lead to statistically significant reductions in alcohol-related harms. Effectiveness of Policies Restricting Hours of Alcohol Sales in Preventing Excessive Alcohol Consumption and Related Harms, Hahn et al., American Journal of Preventative Medicine, Dec 2010; 39(6): 590-604; and

WHEREAS, Norway found that “[e]very 1 hour extension of closing hours was associated with a statistically significant increase of 4.8 assaults per 100,000 inhabitants per quarter” or roughly a 16% increase in assaults. The Impact of Small Changes in Bar Closing Hours on Violence. The Norwegian experience in 18 cities, Rossow & Norström, Addiction, March 2012, 107(3), 530-537; and

WHEREAS, expanded hours of sales result in increases in alcohol-related harms, requiring increased workloads for law enforcement personnel; and

WHEREAS, LMPD has received 17,609 calls for service and 3,213 reported crimes within 500 feet of an establishment with a 4 a.m. alcohol sales license within the past year; and

WHEREAS, a temporary reduction in the sales hours of alcohol for on-premises consumption from 4:00 a.m. to 2:00 a.m. could allow more effective enforcement of alcohol laws and regulations and result in a reduction in harms to the community.

NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (THE COUNCIL) AS FOLLOWS:

 

SECTION I:    (A)                     No licensee with an extended hour supplemental license shall serve sell, serve, or permit the consumption of distilled spirits, wine, or malt beverages after 2:00 a.m. from 7 days after the effective date of this ordinance until the latter of either:

                     (1)                      December 30, 2021; or

                     (2)                      June 30, 2022, if Metro Council takes further action to extend by six months this temporary limitation on extended hour supplemental licensees before December 30, 2021.

   (B)                     During the temporary period limiting the hours in which extended hour supplemental licensees shall sell, serve, or permit the consumption of distilled spirits, wine, or malt beverages, no pending extended hour supplemental license applications or renewals shall be granted for the hours between 2 a.m. and 4 a.m.

   (C)                     The Derby exceptions codified 113.40(C) and 113.41(C) shall not be affected or limited by this temporary ordinance.

SECTION II: Metro Alcoholic Beverage Control is hereby directed to provide notice of the provisions to Section I of this Ordinance to each licensee holding an extended hour supplemental license for the hours between 2:00 a.m. and 4:00 a.m.

SECTION III: This Ordinance shall take effect upon its passage and approval.
