WHEREAS, the Tyler Town Center Planned Development District was created in 2010 for properties generally bounded by Taylorsville Road, I-265, Urton Lane, and Tucker Station Road, containing approximately 123 acres and being in Louisville Metro (the "PDD");
WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government (the "Council") had previously enacted Resolution No. 40, Series 2021 requesting the Louisville Metro Planning Commission (the "Planning Commission") to undertake a review of Limited Use Category II with respect to Area IIC of the PDD;
WHEREAS, the Council previously enacted, pursuant to Ordinance No. 078, Series 2021, a six month moratorium wherein no new non-residential development applications, including without limitation, rezoning, conditional use permits, and plan certain, category 2B and 3 development plan applications will be accepted that contemplate Limited Use Category 2 as one or more of the proposed uses in Area IIC of the PDD while the Planning Commission reviewed potential changes to the PDD;
WHEREAS, the concerns that led to the enactment of Resolution No. 40, Series 2021 have been resolved, eliminating the need for a review, and the temporary moratorium; and
WHEREAS, the Council desires to lift the temporary moratorium as it is no longer necessary.
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
