AN ORDINANCE IMPOSING A TEMPORARY MORATORIUM ON THE USE OF SECTION 4.3.20 OF THE LAND DEVELOPMENT CODE TITLED "MIXED RESIDENTIAL DEVELOPMENT INCENTIVE (MRDI)".

WHEREAS, the Mixed Residential Development Incentive (the "MRDI") was added to the Land Development Code (the "LDC") in 2015; and
WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government (the "Council") has introduced a resolution contemporaneously with this proposed ordinance requesting the Louisville Metro Planning Commission (the "Planning Commission") to undertake a review of the MRDI; and
WHEREAS, the Council would like to create a temporary period wherein no new development applications will be accepted that contemplate the use of the MRDI while the Planning Commission reviews potential changes to the MRDI; and
WHEREAS, it is anticipated that this review will take approximately six months to initiate and complete; and
WHEREAS, during the pendency of such review, the Council desires to preserve the status quo by preventing changes that might render the Planning Commission's review meaningless.
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

SECTION I: There is hereby imposed a moratorium on the acceptance and further processing by Louisville Metro Planning & Design Services, Louisville/Jefferson County Metro Planning Commission, and Louisville/Jefferson County Board of Zoning Adjustment of any development applications that propose to utilize the MRDI.
SECTION II: This Ordinance shall take effect upon its passage and approval and shall remain in effect for a period of one hundred eighty (180) calendar days after its effective date unless repealed or extended.
