A RESOLUTION RECOGNIZING THE ORIGINAL HIGHLANDS NEIGHBORHOOD ASSOCIATION AND THE OFFICIAL NEIGHBORHOOD MAP OF THE ORIGINAL HIGHLANDS NEIGHBORHOOD.

WHEREAS, based on a federal urban neighborhood mapping grant in the late 1970s, the boundary lines for what is more commonly known as the Original Highlands neighborhood is listed on the Louisville/Jefferson County Information Consortium (“LOJIC”) system as the “Highlands Neighborhood;” and
WHEREAS, a copy of the neighborhood map showing the boundary lines of the “Highlands Neighborhood” in LOJIC is attached as Exhibit A to this Ordinance; and
WHEREAS, the map for the Original Highlands neighborhood also is listed as the Highlands Neighborhood on the PVA website, even though that website recognizes a difference between the Original Highlands Neighborhood and the larger collection of neighborhoods in the area collectively commonly referred to as the “Highlands;” and
WHEREAS, subsequent to the listing of the Highlands Neighborhood on LOJIC, the Legislative Council of the Louisville/Jefferson Metro Government (the “Council”) adopted Louisville Metro Code of Ordinances (“LMCO”) §§161.35-161.98 which allows for the maintenance and updating of neighborhood maps on LOJIC; and
WHEREAS, subsequent to the enactment of LMCO §§161.35-161.98, other resources, such as Google Maps and the Property Valuation Administrator, also contain neighborhood maps; and
WHEREAS, on November 28, 2006, the Council adopted the Original Highlands Neighborhood Plan final report and executive summary pursuant to Ordinance No. 206, Series 2006 and Ordinance No. 207, Series 2006 (the “Neighborhood Plan Ordinances”); and
WHEREAS, the boundary line for the study area for the Original Highlands Neighborhood Plan, as described in the Neighborhood Plan Ordinances, included both the Original Highlands neighborhood, as identified under that name on page 3 of the Original Highland Neighborhood Plan final report, and parts of several adjoining neighborhoods, identified separately as part of the broader study area; and
WHEREAS, the Original Highlands Neighborhood Association (the “Association”) has requested that the neighborhood map for what is currently listed as the Highlands Neighborhood on LOJIC to be updated to, and renamed as, the Original Highlands Neighborhood pursuant to LMCO §161.38; and
WHEREAS, the Association has provided the necessary documentation pursuant to LMCO §161.36 to Develop Louisville, as successor to the Department of Neighborhoods, requesting that the Association be recognized and that the name of the neighborhood map currently described on LOJIC as the Highland Neighborhood be updated and renamed as the Original Highlands Neighborhood; and
WHEREAS, Develop Louisville has reviewed the application pursuant to LMCO §161.36(B), has determined that the application is in compliance with LMCO §161.36(A) and has requested Council to formally recognize the Association by resolution and to update the name of the neighborhood map on LOJIC that is currently listed from the Highlands Neighborhood to the Original Highlands Neighborhood; and
WHEREAS, the Council wishes to recognize the Association by resolution, to update the name of the neighborhood map currently described on LOJIC as the Highlands Neighborhood to the Original Highlands Neighborhood, and to encourage other map resources, such as those maintained by Google Maps and the Property Valuation Administrator to also update the name to the Original Highlands Neighborhood.
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I: The Council recognizes the Original Highlands Neighborhood Association as a neighborhood organization pursuant to LMCO §161.36(B).
SECTION II: In accordance with Section I, the Council requests LOJIC to update its neighborhood maps pursuant to LMCO §161.38 to reflect that the name of the neighborhood map currently known as the Highlands Neighborhood on LOJIC shall now be the Original Highlands Neighborhood.
SECTION III: The Council further requests other entities that map neighborhoods, such as Google Maps and the Property Valuation Administrator, to update their maps to reflect the name of the Original Highlands Neighborhood.
SECTION IV: This Resolution shall take effect upon its passage and approval or otherwise becomes law.
