Title
A RESOLUTION DESIGNATING CERTAIN CENSUS BLOCKS LOCATED IN COUNCIL DISTRICTS 1, 2, 3, 4, 5, 6, 10, 12, 15, 21, AND 24 AS PRIORITY PROJECT AREAS TO BE INCLUDED IN THE TAX DELINQUENCY DIVERSION PROGRAM. (AS AMENDED)

WHEREAS, KRS 99.727 authorizes the establishment of a Tax Delinquency Diversion Program (“TDDP”) for blighted property; and
WHEREAS, Metro Council has established a TDDP in Section 38.11 of the Louisville Metro Code of Ordinances, and designated the Louisville and Jefferson County Landbank Authority, Inc., (“Landbank”) as the body responsible for identifying, certifying and recommending priority project areas and individual parcels of property to be included in the TDDP;
WHEREAS, on June 5, 2017, the Landbank recommended and certified that certain project priority areas qualified for and should be in the TDDP; and
WHEREAS, via Resolution No. 052, Series 2017, Metro Council approved the Landbank’s certification that the census blocks each had a significant number of blighted properties; that existing conditions within said census blocks were favorable for redevelopment; that existing resources needed for urban redevelopment were present; and that existing characteristics of the areas could be promoted as part of a campaign to retain existing residents and attract new residents to the areas; and
WHEREAS, pursuant to KRS 99.727(5), certificates of delinquency for properties within the approved priority project areas were not made available for purchase by any person for a period of five (5) years following the year in which the properties were placed in the TDDP; and
WHEREAS, on October 10, 2022, pursuant to the Certification and Recommendation attached as Exhibit A and made a part hereof, the Landbank certified the census blocks listed on Exhibit B attached hereto and made a part hereof as priority project areas and recommended that said census blocks be included in the TDDP; and
WHEREAS, Metro Council approves the Landbank’s recertification that the census blocks listed in Exhibit B attached hereto each still has a significant number of blighted properties; that existing conditions within said census blocks are still favorable for redevelopment; that existing resources needed for urban redevelopment are still present; and that existing characteristics of the areas can still be promoted as part of a campaign to retain existing residents and attract new residents to the areas; and
WHEREAS, upon approval by Metro Council, and pursuant to KRS 99.727(5), certificates of delinquency for properties within approved priority project areas shall not be available for purchase by any person for a period of one (1)five (5) years following the year in which the properties placed in the TDDP have that placement renewed.
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I: That Metro Council approves the recommendation of the Landbank that the census blocks listed on Exhibit B attached hereto be included in the TDDP for a period of one (1)five (5) years.
SECTION II: This Resolution shall become effective upon passage and approval or as otherwise provided by law.
