AN ORDINANCE AMENDING LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT CODE OF ORDINANCES CHAPTER 151 EVICTION COURT.

WHEREAS, the Legal Aid Society, the Designated Organization under Chapter 151, Section 60, has successfully implemented a program providing legal assistance to those facing eviction;
WHEREAS, the program limits participants to applicants whose annual gross income does not exceed 125% of the federal poverty guidelines and applicants who have at least one child;
WHEREAS, the Legal Aid Society has exhausted program applicants meeting these criteria and has grant funds remaining; and
WHEREAS, to utilize the remaining grant funds and to expand the program of providing legal counsel to indigent community members facing eviction, the Sponsor wishes to remove the criteria requiring applicants to have at least one child;
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (THE COUNCIL) AS FOLLOWS:

SECTION I: the Louisville/Jefferson County Metro Government Code of Ordinances, Chapter 151, Section 60 is amended as follows:
COVERED INDIVIDUAL. Any person who occupies a dwelling, with at least one child, under a valid lease or other instrument demonstrating a claim of legal right, other than the owner, whose annual gross income is not in excess of 125% of the federal poverty guidelines as established and updated periodically by the United States Department of Health and Human Services (42 U.S.C. 9902(2)).
SECTION II: This Ordinance shall be effective upon its passage and approval or otherwise becoming law.
