AN ORDINANCE IMPOSING A TEMPORARY MORATORIUM ON CONDITIONAL USE PERMITS FOR SHORT TERM RENTALS IN RESIDENTIAL ZONING DISTRICTS PENDING THE ADOPTION OF REVISED REGULATIONS.

WHEREAS, the Planning Commission is currently undertaking a review of the short term rental regulations in the Land Development Code Section 4.2.63;
WHEREAS, there has been substantial concern that short term rentals in residential zoning districts destabilize the residential character of the neighborhoods in which they are located particularly where the property is not the primary residence of the host;
WHEREAS, the Council would like to create a period wherein no new conditional use permit applications for short term rentals in residential zones where the property is not the primary residence of the host will be accepted or processed during the pendency of the review and adoption of revised short term rental regulations;
WHEREAS, during the pendency of such review and adoption of revised short term rental regulations, the Council desires to preserve the status quo by preventing changes to the existing land uses; and
WHEREAS, it is anticipated that the review and adoption of revised short term rental regulations will take no more than three months.
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I: There is hereby imposed a temporary moratorium on the acceptance and processing by Louisville Metro Planning and Design Services, Louisville/Jefferson County Metro Planning Commission, and Louisville/Jefferson County Board of Zoning Adjustment of any conditional use permit applications for short term rentals in residential zoning districts where the property is not the primary residence of the host throughout Metro Louisville.
SECTION II: This moratorium shall be effective until it expires on the earlier of three months from the effective date of this Ordinance or the effective date of the revised short term rental regulations.
SECTION III: This Ordinance shall take effect upon its passage and approval.
