A RESOLUTION REQUESTING THE LOUISVILLE METRO DEPARTMENT OF PLANNING AND DESIGN SERVICES TO REVIEW THE LAND DEVELOPMENT CODE AND MAKE RECOMMENDATIONS REGARDING THE VARIOUS FORMS OF TEMPORARY HOUSING IN RESIDENTIAL ZONING DISTRICTS.

WHEREAS, there are several forms of temporary housing (hereinafter defined) allowed as conditional uses or as permitted uses with special standards within certain designated zoning districts; and
WHEREAS, the forms of temporary housing are: Transitional Housing, Boarding and Lodging Houses, Homeless Shelters, Rehabilitation Houses and Residential Care Facilities (collectively referred to as “Temporary Housing”);
WHEREAS, the lack of standards and fraudulent and predatory temporary housing has caused issues with nuisance and general compatibility within residential areas; and
WHEREAS, additional standards for the conduct of temporary housing uses may aid in reducing the conflicts and nuisances experienced in residential areas; and
WHEREAS, enhanced enforcement of the Land Development Code would also serve to make temporary housing more compatible with surrounding residential uses.
NOW THEREFORE BE IT RESOVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I: Louisville Metro Planning and Design Services is hereby directed to review the Land Development Code regarding temporary housing in residential zoning districts to consider adoption of additional standards to improve the compatibility of these uses within residential areas and also make recommendations that will aid in the enforcement of the regulations to ensure compliance. Louisville Metro Planning and Design Services shall meet and work with the Louisville Metro Department of Public Health and Wellness and stakeholders to review and consider any revisions to these regulations.
SECTION II: This Resolution shall take effect upon its passage and approval.
