A RESOLUTION REQUESTING THE PLANNING COMMISSION REVIEW THE FLOYDS FORK SPECIAL DISTRICT IN CHAPTER 3, PART 1 OF THE LAND DEVELOPMENT CODE (“LDC”) (AS AMENDED).

WHEREAS, following the Louisville Metro Planning Commission’s (“Planning Commission’s”) recommendation, on August 10, 2020, the Legislative Council of the Louisville/Jefferson County Metro Government (“Council”) passed Ordinance No. 084, Series 2020, approving the South Floyds Fork Vision Plan (the “Vision Plan”) and its executive summary; and

WHEREAS, the goal of that Vision Plan is to ensure authentic, healthy, equitable, sustainable, and well-connected growth in the Floyds Fork area; and

WHEREAS, Community Form Recommendation 3(A) of the Vision Plan advised Council was to “Analyze and revise the Floyds Fork DRO [development review overlay] in its current state to eliminate redundancies, provide clear standards and to reflect current needs and conditions. The revision process should be inclusive and represent the diversity of the community;” and

WHEREAS, an inclusive process should engage all stakeholders, including homeowners, landowners, renters, environmentalists, developers, parks officials, water quality experts, adjacent business owners, outdoor recreation enthusiasts, and other groups impacted by growth in the Floyds Fork area; and

WHEREAS, the Floyds Fork Development Review Overlay (“DRO”) is contained in Chapter 3, Part 1 of the LDC as part of the Floyds Fork Special District; and

WHEREAS, undertaking the review recommended by the Vision Plan is necessary and in the public interest; and

WHEREAS, as part of the review, the Planning Commission and its staff should review the DROrecommendations contained in the Vision Plan, and should also consider whether a development review overlay committee, consisting of environmental experts and community members, should be established to work in concert with the Planning Commission and Staff in order to betterto review environmental issues relating to development within the entire Floyds Fork DRO; and

WHEREAS, development continues to occur in and near the Floyds Fork DRO, increasing the need for such a review and revision process to occur.

NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

 

SECTION I: Planning Commission and its staff shall undertake a review of the Floyds Fork Special District in Chapter 3, Part 1 of the LDC, with such review to include a review of the recommendations contained in the Vision Plan as well as to consider whether a development review overlay committee, consisting of environmental experts and community members, should be established to work in concert with the Planning Commission and Staff in order to better review environmental issues relating to development within the Floyds Fork DRO, and develop recommendations thereto to the Council. Although the Planning Commission should be informed by the recommendations contained in the Vision Plan, it should not reopen or reconsider those recommendations.

SECTION II: The Planning Commission shall report its recommendations to Council no later than December 31, 2022.

SECTION IIIII: This Resolution shall take effect upon its passage and approval or otherwise becoming law.
