A RESOLUTION RECOGNIZING THE AUTHORITY OF THE JEFFERSON COUNTY SHERIFF TO MAKE APPLICATION FOR AND ENTER INTO AGREEMENTS WITH THE KENTUCKY OFFICE OF HOMELAND SECURITY (KOHS) FOR PROJECTS TO OBTAIN PROTECTIVE SAFETY VESTS, TASERS, MOBILE DATA COMPUTERS, AND RADIO AND SPECIAL TEAM EQUIPMENT, TO EXECUTE ANY DOCUMENTS WHICH ARE DEEMED NECESSARY BY KOHS TO FACILITATE AND ADMINISTER THESE PROJECTS AND TO ACT AS THE AUTHORIZED CORRESPONDENT FOR THESE PROJECTS.

WHEREAS, the Jefferson County Sheriff has the authority and desires to make an application for grant funds through the KOHS for projects to obtain protective safety vests, tasers, mobile data computers, and radio and special team equipment; and
WHEREAS, the KOHS has requested a duly adopted resolution of the Metro Council recognizing and approving the Jefferson County Sheriff's authority to make application for and receive the necessary funds for the above described projects; and
WHEREAS, even though the Jefferson County Sheriff annually submits the budget for said office to the Metro Council for its approval, the Metro Council acknowledges that the application and receipt of these funds, as well as the execution of any agreements pursuant to the above described KOHS projects, will not have any budgetary implications which would require additional Metro Council review and approval; and
WHEREAS, the Jefferson County Sheriff intends, if necessary, to expend monies as matching funds from reserves in his office's aforementioned operating budget approved by the Metro Council in order to obtain grant funds for these projects; and
WHEREAS, the Metro Council recognizes that an application for and approval of KOHS funds may impose certain obligations and responsibilities upon the Jefferson County Sheriff but said constitutional office has the independent lawful authority to make application for and to enter into any agreements required by KOHS to facilitate the above described projects and act as its own authorized correspondent for said projects.
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
 
SECTION I.  The Metro Council recognizes and approves the authority of the Jefferson County Sheriff to execute and furnish all required documentation, including any necessary contract or memorandum of agreement, as may be required by KOHS for the furtherance of the above-referenced projects for protective safety vests, tasers, mobile data computers, and radio and specialty team equipment and to act as the authorized correspondent for said projects.
SECTION II.      This Resolution shall take effect upon its passage and approval.
