WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government (the "Council") previously approved the zoning change in connection with 908 S. English Station Road pursuant to Ordinance No. 141, Series 2024 (the "2024 Ordinance"); and
WHEREAS, as part of the 2024 Ordinance, Binding Element #15, which does not permit any C-1, C-2, M-1, or C-M uses on the site other than "mini-storage and recreational vehicles and boat/landscape trailer parking," and Binding Element #18 provides that "Any amendments to the binding elements other than (i) the addition of new binding elements, (ii) changes to binding elements that merely update the public hearing date, or (iii) updating a previous version of this binding element to reflect current language, shall be reviewed before the Planning Commission with final action to be determined by Metro Council;" and
WHEREAS, an amendment to Binding Element #15 has been proposed for 908 S. English Station Road pursuant to Case No. 26AMEND0002 which would add "and Short-Term Rental of the existing north building on the site until such time as the mini-storage building is constructed" as a permitted use; and
WHEREAS, the Council has considered the evidence presented at the public hearing held by the Louisville Metro Planning Commission (the "Planning Commission") and the recommendations of the Planning Commission and its staff as set out in the minutes and records of the Planning Commission in Case No. 26AMEND0002; and
WHEREAS, the Council concurs in and adopts the findings of the Planning Commission approving the proposed amendment to Binding Element #15 in Case No. 26AMEND0002 and approves and acc...
