WHEREAS, property within the 100 block of West Main Street and Washington Street known as “Whiskey Row” has been redeveloped into a tourist destination showcasing the rich history and traditions of the City of Louisville and the Commonwealth of Kentucky, and providing a unique shopping, dining, and hospitality venue; and
WHEREAS, owners of property within Whiskey Row have formed Whiskey Alley, Inc., to further promote Whiskey Row’s status as a world-class destination that will enhance the experience of visitors to the KFC Yum! Center, the Kentucky International Convention Center, and the area’s other attractions by offering outdoor music, dining, and beverage options in a unique, pedestrian-friendly atmosphere in the cultural center of the region; and
WHEREAS, Louisville Metro Government seeks to create an Entertainment Destination Center for which Whiskey Alley, Inc., will apply for a license from the Kentucky Department of Alcoholic Beverage Control; and
WHEREAS, Section 243.030(21) of the Kentucky Revised Statutes authorizes the issuance of an Entertainment Destination Center License by the Kentucky Department of Alcoholic Beverage Control; and
WHEREAS, the state ABC regulations require that Louisville Metro enact an ordinance with the geographic boundaries of the Entertainment Destination Center and a determination that the licensed premises would aid economic growth and tourism in the city (804 KAR 4:370); and
WHEREAS, Louisville Metro Council believes that the creation of an Entertainment Destination Center in the Whiskey Alley location as defined in this ordinance will aid in the economic growth and tourism in Louisville Metro.
BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I: A new section of Chapter 113 of the Louisville Metro Code of Ordinances (“LMCO”) is hereby created as follows:
§ 113.XX: WHISKEY ALLEY ENTERTAINMENT DESTINATION CENTER
(A) Louisville Metro hereby establishes an Entertainment Destination Center (“EDC”) in Whiskey Alley upon the belief that Whiskey Alley satisfies the requirements contained in the definition of an EDC as required by Section 1 of 804 KAR 4:370, including the belief that Whiskey Alley will aid economic growth and tourism in Louisville Metro and for the community around the Whiskey Alley area.
(B) The geographical boundaries of the Whiskey Alley EDC are as follows:
WASHINGTON STREET: A tract of land being the right-of-way of West Washington Street between North First Street and North Second Street, Louisville, Jefferson County, Kentucky and being more particularly described as follows:
Beginning at the Northwest corner of the right-of-ways of West Washington Street and North First Street; thence along the West right-of-way line of North First Street, South 8°00’00” West (North and all bearings hereon refer to Witherspoon subdivision, of record in plat and subdivision book 36, page 67, in the office of the Clerk of Jefferson County), 50.37 feet; thence along the South Right-of-Way line of West Washington Street, North 81°58’42” West, 419.74 feet to the South East right-of-way corner of West Washington Street and North Second Street; thence along the East line of North Second Street, North 7°42’30” East, 50.37 feet; thence along the North Right-of-Way line of West Washington Street, South 81°58’42” East, 320.00 feet to the point of beginning.
FIRST STREET SIDEWALK: A tract of land along the West side of North First Street between West Washington Street and West Witherspoon Street, Louisville, Jefferson County, Kentucky and being more particularly described as follows: Beginning at the South West corner of the right-of-ways of West Washington Street and North First Street; thence along the West right-of-way of North First Street, North 8°00’00” East (North and all bearings hereon refer to Witherspoon subdivision, of record in plat and subdivision book 36, page 67, in the office of the clerk of Jefferson County), 335.95 feet to the South West corner of the right-of-ways of North First Street and West Witherspoon Street; thence along the South Right-of-Way of West Witherspoon Street, South 82°00’00” East, 9.92 feet to the face of the concrete curb; thence along the face of said concrete curb, South 7°57’09” West, 335.95 feet to the South right-of-way line of West Washington Street; thence along said South right-of-way line of West Washington Street, North 81°58’42” West, 9.90 feet to the point of beginning.
SECOND STREET SIDEWALK: A tract of land along the East side of North Second Street between West Main Street and West Washington Street, Louisville, Jefferson County, Kentucky and being more particularly described as follows: Beginning at the North East corner of the Right-of-Ways of West Washington Street and North Second Street; thence along the East Right-of-Way line of North Second Street, South 7°54’17” West (North and all bearings hereon refer to Witherspoon Subdivision, of record in plat and Subdivision Book 36, page 67, in the office of the clerk of Jefferson County), 254.37 feet to the North East corner of the Right-of-Ways of West Main Street and North Second Street; thence along the North Right-of-Way line of West Main Street, North 82°02’13” West, 11.22 feet to the face of the concrete curb; thence along the face of said concrete curb, North 7°54’17” East, 254.38 feet to the North right-of-way of West Washington Street; thence along the North right-of-way of West Washington Street, South 81°58’42” East, 11.05 feet to the point of beginning.
ALLEYWAY AT 111 WEST WASHINGTON STREET: A private alley located on 111 West Washington Street, Louisville, Jefferson County, Kentucky and being more particularly described as follows: Beginning at the South West corner lot 5 as shown on the plat of Witherspoon subdivision, of record in plat and subdivision book 36, page 67, in the office of the Clerk of Jefferson County; thence along the West line of said lot 5 North 8°00’00” East (North and all bearings hereon refer to Witherspoon subdivision, of record in plat and subdivision book 36, page 67, in the Office of the Clerk of Jefferson County) 126.00 feet; thence running South 81°58’42” East to the Western face of a building; thence along the Western face of said building to the North Right-of-Way of West Washington Street; thence along the North Right-of-Way of West Washington Street, North 81°58’42” West to the point of beginning.
(C) Whiskey Alley shall comply with all applicable laws and licensing requirements to
operate as an EDC.
SECTION II: This Ordinance shall take effect upon its passage and approval.
