A RESOLUTION APPROVING A PETITION FOR WIDENING RIVER ROAD FROM ZORN AVENUE TO EDITH AVENUE BROUGHT PURSUANT TO K.R.S CHAPTER 178.080 AND APPROVING THE DEDICATION OF ONE PARCEL OF REALTY LOCATED ON THE NORTH SIDE OF RIVER ROAD FOR THE ABOVE REFERENCED WIDENING OF RIVER ROAD BY LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (“METRO GOVERNMENT”) SUCCESSOR TO THE CITY OF LOUISVILLE, KENTUCKY.

WHEREAS,                      Metro Government wishes to widen River Road between Zorn Avenue and Edith Avenue by dedicating one parcel of real estate described in Exhibit A attached hereto for such widening; and

WHEREAS, the plans for widening this portion of River Road are set out generally in Exhibit B attached hereto; and

WHEREAS, the widening of River Road as outlined in Exhibits A and B attached hereto is in the best interests of Metro Government and its citizens; and

WHEREAS, the acting county road engineer of Metro Government, Jeffrey Brown, has investigated and approved the widening of River Road as shown in Exhibits A and B attached hereto; and

WHEREAS, the Mayor of Metro Government has previously approved the widening of River Road as detailed in Exhibits A and B attached hereto; and

WHEREAS, the Louisville/Jefferson County Metro Council, on January 24, 2013 in Resolution No. 020, Series 2013, approved a resolution authorizing the Mayor’s signature entering into an agreement with the Commonwealth of Kentucky Transportation Cabinet concerning a project to widen River Road from Beargrass Creek to Zorn Avenue; and

WHEREAS, Metro Government wishes to add the widened River Road to the county through road system.

NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (“METRO COUNCIL”) AS FOLLOWS:

 

SECTION I: The Metro Council determines that the widening of River Road as shown in Exhibits A and B attached hereto is in the best interest of Metro Government and its citizens.

SECTION II: The dedication of the parcel of real estate set out in Exhibit A attached hereto for the widening of River Road as outlined herein is hereby approved by the Metro Council.

SECTION III: The acting county road engineer of Metro Government is hereby instructed to add the widened River Road to the county through road system.

SECTION IV: This Resolution shall become effective upon its passage and approval.

Being a tract of land lying in Jefferson County along River Road approximately 1.08 miles west of the intersection of Zorn Avenue and River Road, and more particularly described as follows:

 

Beginning at a point in the north existing right of way of River Road, said point being 51.29 feet left of River Road centerline station 1011+43.03; thence with the east property line of the City of Louisville North 14°38'39" West a distance of 13.91 feet to a point 64.55 feet left of River Road centerline station 1011+47.25, said point being in the north proposed right of way line of River Road; thence with said proposed right of way line North 61°18'19" East a distance of  72.90 feet to a point 60.00 feet left of River Road centerline station 1012+20.00; thence with the proposed right of way line North 57°43'44" East a distance of 381.06 feet to a point 60.00 feet left of River Road centerline station 1016+01.06, said point also being in the west property line of River Metals Recycling, LLC; thence with said property line South 32°57'10" East a distance of 15.79 feet to a point 44.22 feet left of River Road centerline station 1016+01.25, said point also being in the north existing right of way line of River Road; thence with said existing right of way South 58°36'47" West a distance of 458.27 feet to the point of beginning.

 

The above described parcel contains 0.132 acres (5,768 sq. ft.) of right of way.

 

Being a part of the same real property conveyed to the City of Louisville by deed dated May 4, 1955, and recorded in Deed Book 3311, Page 522 in the office of the Jefferson County Clerk.
