A RESOLUTION RELATING TO THE REDISTRICTING OF METRO COUNCIL DISTRICTS REQUIRED FOLLOWING THE 2020 DECENNIAL CENSUS.

WHEREAS, KRS 67C.103(3) requires Metro Council to redistrict Council districts, if needed, following the official publication of each decennial census by the U.S. Bureau of the Census ("Census Bureau"); and
WHEREAS, KRS 67C.135(5) provides that the Council shall initiate the reapportionment process in May of the first year following the decennial census; and
WHEREAS, KRS 67C.135(7) prohibits any reapportionment of Council districts during the period from 30 days before the last filing deadline for a candidate for a local government office and the regular election for candidates for local government office; and
WHEREAS, the Census Bureau undertook a decennial census in 2020; and
WHEREAS, as a result of various factors, including but not limited the challenges posed by COVID-19, the Census Bureau has not yet provided to states the official census data that is essential to evaluating the need for any redistricting process; and
WHEREAS, the latest estimates by the Census Bureau indicate that states should receive the data they need to begin redistricting by August 16, 2021, with the final redistricting data toolkit to be delivered by September 30, 2021. https://www.census.gov/newsroom/press-releases/2021/2020-census-apportionment-results.html
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT ("THE COUNCIL") AS FOLLOWS:

SECTION I: The Council hereby acknowledges its statutory duty to review decennial census data and to reapportion Council districts if the data so requires.
SECTION II: The Council will fulfill those responsibilities in accordance with all statutory requirements after receipt of the necessary information from the U.S. Bureau of the Census.
