AN ORDINANCE AMENDING CHAPTER 113 OF THE LOUISVILLE METRO CODE OF ORDINANCES ("LMCO") MAKING IT UNLAWFUL FOR ALCOHOLIC BEVERAGE CONTROL ("ABC") LICENSEES TO SELL DRUG PARAPHERNALIA.

WHEREAS, Metro Council is concerned with the compliance of current drug laws as well as the public health problems associated with drug-related crime and violence in the community;
WHEREAS, Metro Council believes prohibiting the sale of drug paraphernalia at ABC licensed premise will help enforce drug laws as well as reduce crime and violence in the community; and
WHEREAS, to accomplish this objective, Metro Council modifies the conditions governing ABC licenses to prohibit ABC licensees from selling drug paraphernalia at their establishments.
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I. Section 113.22(E) of the LMCO is hereby amended as follows:
?113.22 CONDITIONS GOVERNING LICENSES.
(E) It shall be unlawful for any licensee under this chapter to sell, keep or permit to be sold or used, or kept on the licensed premises any controlled substances as defined in KRS Chapter 218A or drug paraphernalia as defined in KRS Chapter 218A.500. In addition to other penalties set out in this chapter for the violation of this section the Louisville Metro Government ABC Administrator shall also have the authority to revoke the license issued to the premises.
SECTION II. This Ordinance shall take effect upon passage and approval.
