TITLE

A RESOLUTION ACKNOWLEDGING SATISFACTION OF CONDITIONS PRECEDENT ON THE APPROPRIATION AUTHORIZING PREMIUM PAY FOR SUBURBAN FIRE AND EMS EMPLOYEES.

WHEREAS, Ordinance No. 168, Series 2021, approving a second round of American Rescue Plan funding, included appropriations for premium pay for Metro employees and for certain component units and external agencies; and

WHEREAS, premium pay appropriations were required to be made in accordance with a three-tier system as follows:

Tier I: $5,000 - essential staff; front line employees that were unable to regularly telework; had regular interaction with the public; worked directly with the public dealing with Covid related interactions; handled items handled by others;

 

Tier II: $1500 - essential staff; employees that were unable to regularly telework; had regular interaction with peers in an office setting; regularly handled items handled by others;

 

Tier III: $500 - all other employees that do not fall into Tier I or Tier II; and

 

WHEREAS, receipt of premium pay also required either proof of full vaccination status or an authorized waiver of vaccination; and

WHEREAS, in light of the invaluable services provided throughout all of Jefferson County by the eight fire protection districts created pursuant KRS Chapter 75 (“the Chapter 75 Fire Districts”), none of whom received a direct allocation of ARP funding, Ordinance No. 168, Series 2021 approved a premium pay appropriation for these Suburban Fire and EMS employees in accordance with the requirements above, subject to the satisfaction of two conditions precedent: (1) the creation of an acceptable cost sharing arrangement whereby suburban cities would also contribute to premium pay for these personnel; and (2) the adoption of premium pay distribution and vaccination or declination requirements like those that applied to Metro’s own employees; and

WHEREAS, the suburban fire districts, by and through their authorized representatives, have established to Metro Council’s satisfaction that these conditions precedent have been satisfied, although additional contributions from suburban cities are still being received and are encouraged; and have designated JCSFS, Inc.as the non-profit entity authorized by the Chapter 75 Fire Districts to administer premium pay for their employees.

NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

 

SECTION I: The conditions necessary for the release of the premium pay appropriation for the Suburban Fire and EMS personnel authorized in Ordinance No. 168, Series 2021 have been met. The Office of Management and Budget may proceed to prepare and execute all necessary grant documents to transfer funds to JCSFS, Inc. for ultimate transfer to the Chapter 75 Fire Districts and their employees.

SECTION II:                     This Resolution shall take effect upon its passage and approval or otherwise becoming law.
