TITLE
AN ORDINANCE RELATING TO THE ZONING OF PROPERTIES LOCATED AT 10212 AND 10302 OAK GROVE ROAD CONTAINING APPROXIMATELY 68.57 ACRES AND BEING IN LOUISVILLE METRO (CASE NO. 21ZONE0059) (AMENDMENT BY SUBSTITUTION)(AS AMENDED).

WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government (the “Council”) has considered the evidence presented at the public hearing held by the Louisville Metro Planning Commission and the recommendations of its Staff as set out in the minutes and records of the Planning Commission in Case No. 21ZONE0059; and
WHEREAS, the Council wishes to allow the applicant an opportunity to present the Planning Commission with an amended proposal without being required to go back through the entire rezoning process or being inhibited by the 2-year rule; and
WHEREAS, hearing and decision requirements contained in KRS Chapter 100 are currently suspended per Senate Bill 150(9)(a) due to the ongoing COVID-19 related state of emergency; and
WHEREAS, this suspension of relevant deadlines by the State legislature affords both the Planning Commission and Metro Council ample time to consider this case; and
WHEREAS, in order to ensure all issues are thoroughly reviewed and discussed, the Council believes it appropriate to have a neighborhood meeting, then to have the Land Development and Transportation Committee (“LDT”) review the applicant’s proposal and, once ready, to schedule a full hearing at the Planning Commission; and
WHEREAS, the Council will make a final decision on the zoning when the Planning Commission has completed this second review whether the recommendation is to rezone or maintain the existing zoning.
NOW THEREFORE BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISIVLLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I: That the zoning of the properties located at 10212 and 10302 Oak Grove Road containing approximately 68.57 acres and being in Louisville Metro, as more particularly described in the minutes and records of the Planning Commission in Case No. 21ZONE0059, is hereby returned to the Land Development and Transportation Committee of the Planning Commission for further consideration. The applicant shall hold a neighborhood meeting on the revised plan before appearing at LDT.
SECTION II: This Ordinance shall take effect upon its passage and approval or otherwise becoming law.
